S\u00fct izninin hangi saatler aras\u0131nda ve g\u00fcnde ka\u00e7 kez kullan\u0131laca\u011f\u0131 hususunda, kad\u0131n memurun tercihi esast\u0131r.&#8221;<\/b> h\u00fckm\u00fcnde ge\u00e7en &#8220;g\u00fcnde&#8221; ibaresinden g\u00fcnl\u00fck mesai olan 8 saat mi yoksa t\u00fcm<b>8-16<\/b> veya <b><b>24<\/b><\/b> saat \u00e7al\u0131\u015fmalar\u0131n hepsinin ayn\u0131 \u015fekilde &#8220;g\u00fcn&#8221; olarak d\u00fc\u015f\u00fcn\u00fcl\u00fcp toplamda <b><b>1,5<\/b><\/b> saat s\u00fct izni mi verilmesi gerekti\u011fi, g\u00fcnde 8 saat mesai yapan personelin kullanaca\u011f\u0131 s\u00fct izni s\u00fcresi 1,5 saat olarak hesaplanacak ise 24 saat n\u00f6bet tutan ve ertesi 2 g\u00fcn izin kullanan personelin ka\u00e7 saat s\u00fct izni kullanaca\u011f\u0131 hususlar\u0131nda has\u0131l olan teredd\u00fctlerin giderilmesine ili\u015fkin olarak, Kurumumuz Hukuk M\u00fc\u015favirli\u011finin ilgi (b) say\u0131l\u0131 cevabi<\/p>\n<p style=\"text-align: justify;\">yaz\u0131s\u0131nda;<\/p>\n<p style=\"text-align: justify;\">22\/05\/2003 tarihli ve <b>4857<\/b> say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 73 \u00fcnc\u00fc ve \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanununun 30 uncu maddelerine dayan\u0131larak haz\u0131rlanan ve 24\/07\/2013 tarihli ve 28717 say\u0131l\u0131 Resmi Gazetede yay\u0131nlanan Kad\u0131n \u00c7al\u0131\u015fanlar\u0131n Gece Postalar\u0131nda \u00c7al\u0131\u015ft\u0131r\u0131lma Ko\u015fullar\u0131 Hakk\u0131nda Y\u00f6netmeli\u011fin &#8220;Kapsam&#8221; ba\u015fl\u0131kl\u0131 2 nci maddesinde, &#8220;Bu Y\u00f6netmelik, 20\/6\/2012 tarihli ve 6331 say\u0131l\u0131 t\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu kapsam\u0131ndaki i\u015fyerlerinde on sekiz ya\u015f\u0131n\u0131 doldurmu\u015f kad\u0131n \u00e7al\u0131\u015fanlar\u0131n gece postalar\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131n\u0131 kapsar.&#8221; h\u00fckm\u00fc; &#8220;Tan\u0131mlar&#8221; ba\u015fl\u0131kl\u0131 4 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n (a) bendinde, &#8220;Gece postas\u0131: 4857 say\u0131l\u0131 \u0130\u015f Kanununun 69 uncu maddesinde belirtilen gece \u00e7al\u0131\u015fma s\u00fcrelerini kapsayan ve yedi bu\u00e7uk saati ge\u00e7meyen \u00e7al\u0131\u015fma zaman\u0131n\u0131, ifade eder&#8221; h\u00fckm\u00fc; 5 inci maddesinde, &#8220;Kad\u0131n \u00e7al\u0131\u015fanlar her ne \u015fekilde olursa olsun gece postas\u0131nda yedi bu\u00e7uk saatten fazla \u00e7al\u0131\u015ft\u0131r\u0131lamaz.&#8221; h\u00fckm\u00fc ve &#8220;Gebelik ve anal\u0131k durumunda \u00e7al\u0131\u015ft\u0131r\u0131lma yasa\u011f\u0131&#8221; ba\u015fl\u0131kl\u0131 9 uncu maddesinin birinci f\u0131kras\u0131nda, &#8220;Kad\u0131n \u00e7al\u0131\u015fanlar, gebe olduklar\u0131n\u0131n doktor raporuyla tespitinden itibaren do\u011fuma kadar, emziren kad\u0131n \u00e7al\u0131\u015fanlar ise do\u011fum tarihinden ba\u015flamak \u00fczere kendi mevzuatlar\u0131ndaki h\u00fck\u00fcmler sakl\u0131 kalmak kayd\u0131yla bir y\u0131l s\u00fcre ile gece postalar\u0131nda <b>\u00e7al\u0131\u015ft\u0131r\u0131lamazlar.&#8221;<\/b> h\u00fckm\u00fc d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Mezk\u00fcr Y\u00f6netmeli\u011fin &#8220;Uygulamada \u00f6ncelik&#8221; ba\u015fl\u0131kl\u0131 11 inci maddesinde ise; &#8220;(1) Bu Y\u00f6netmelik h\u00fck\u00fcmlerinin uygulanmas\u0131nda \u00f6ncelikle \u00e7al\u0131\u015fan\u0131n tabi oldu\u011fu ilgili mevzuat h\u00fck\u00fcmleri dikkate alm\u0131r.(2) 6331 say\u0131l\u0131 Kanun kapsam\u0131nda olup kendi \u00f6zel mevzuatlar\u0131nda h\u00fck\u00fcm bulunmamas\u0131 halinde \u00e7al\u0131\u015fanlar a\u00e7\u0131s\u0131ndan bu Y\u00f6netmelik h\u00fck\u00fcmleri uygulan\u0131r.&#8221; h\u00fckm\u00fc mevcuttur.<\/p>\n<p style=\"text-align: justify;\">Yine 6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanununun 30 uncu maddelerine dayan\u0131larak haz\u0131rlanan ve 16\/08\/2013 tarihli ve 28737 say\u0131l\u0131 Resmi Gazetede yay\u0131nlanan Gebe veya Emziren Kad\u0131nlar\u0131n \u00c7al\u0131\u015ft\u0131r\u0131lma \u015eartlar\u0131yla Emzirme Odalar\u0131 ve \u00c7ocuk Bak\u0131m Yurtlar\u0131na Dair Y\u00f6netmeli\u011fin &#8220;Kapsam&#8221; ba\u015fl\u0131kl\u0131 2 inci maddesinde, &#8220;Bu Y\u00f6netmelik, 20\/6\/2012 tarihli ve 6331 say\u0131l\u0131 t\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu kapsam\u0131ndaki kad\u0131n \u00e7al\u0131\u015fan \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerine uygulan\u0131r.&#8221; h\u00fckm\u00fc; &#8220;Uygulamada \u00f6ncelik&#8221; ba\u015fl\u0131kl\u0131 5 inci maddesinde, &#8220;(1) Bu Y\u00f6netmelik h\u00fck\u00fcmlerinin uygulanmas\u0131nda \u00f6ncelikle \u00e7al\u0131\u015fan\u0131n tabi oldu\u011fu ilgili mevzuat h\u00fck\u00fcmleri dikkate al\u0131n\u0131r. (2) 6331 say\u0131l\u0131 Kanun kapsam\u0131nda olup kendi \u00f6zel mevzuatlar\u0131nda h\u00fck\u00fcm bulunmamas\u0131 halinde \u00e7al\u0131\u015fanlar a\u00e7\u0131s\u0131ndan bu Y\u00f6netmelik h\u00fck\u00fcmleri uygulan\u0131r.&#8221; h\u00fckm\u00fc; &#8220;Gece \u00e7al\u0131\u015fmas\u0131&#8221; ba\u015fl\u0131kl\u0131 8 inci maddesinde ise, &#8220;(1) Kad\u0131n \u00e7al\u0131\u015fanlar, gebe olduklar\u0131n\u0131n sa\u011fl\u0131k raporuyla tespitinden itibaren do\u011fuma kadar ge\u00e7en s\u00fcrede gece \u00e7al\u0131\u015fmaya zorlanamazlar. (2) Yeni do\u011fum yapm\u0131\u015f \u00e7al\u0131\u015fan\u0131n do\u011fumu izleyen bir y\u0131l boyunca gece \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 yasakt\u0131r. Bu s\u00fcrenin sonunda sa\u011fl\u0131k ve g\u00fcvenlik a\u00e7\u0131s\u0131ndan sak\u0131ncal\u0131 oldu\u011funun sa\u011fl\u0131k raporu ile belirlendi\u011fi d\u00f6nem boyunca gece \u00e7al\u0131\u015ft\u0131r\u0131lmaz.&#8221; h\u00fckm\u00fc d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Yukar\u0131da bahsi ge\u00e7en ve \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca \u00e7\u0131kar\u0131lan Y\u00f6netmeliklerin 6331 say\u0131l\u0131 Kanun kapsam\u0131ndaki i\u015fyerlerine uyguland\u0131\u011f\u0131, mezk\u00fcr Kanun&#8217;un 2 nci maddesine g\u00f6re, bu Kanun&#8217;un; kamu ve \u00f6zel sekt\u00f6re ait b\u00fct\u00fcn i\u015flere ve i\u015fyerlerine, bu i\u015fyerlerinin i\u015fverenleri ile i\u015fveren vekillerine, \u00e7\u0131rak ve stajyerler de dahil olmak \u00fczere t\u00fcm \u00e7al\u0131\u015fanlar\u0131na faaliyet konular\u0131na bak\u0131lmaks\u0131z\u0131n uyguland\u0131\u011f\u0131 hususu nazar a al\u0131narak, mezk\u00fcr Y\u00f6netmelik h\u00fck\u00fcmlerinin Kurumumuza ba\u011fl\u0131 sa\u011fl\u0131k tesislerinde de uygulanaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclebilir ise de;<\/p>\n<p style=\"text-align: justify;\">4857 say\u0131l\u0131 I\u015f Kanunu&#8217;nun &#8220;Gece \u00e7al\u0131\u015ft\u0131rma yasa\u011f\u0131&#8221; ba\u015fl\u0131kl\u0131 73 \u00fcnc\u00fc maddesinin ikinci f\u0131kras\u0131nda d\u00fczenlenmi\u015f olan, <b>&#8220;Onsekiz vasim doldurmu\u015f kad\u0131n is\u00e7ilerin gece postalar\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131na ili\u015fkin usul ve esaslar Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fc al\u0131narak \u00c7al\u0131\u015fma ve<\/b> Sosyal <b>G\u00fcvenlik Bakanl\u0131\u011f\u0131nca haz\u0131rlanacak bir y\u00f6netmelikte g\u00f6sterilir&#8221;<\/b> h\u00fckm\u00fc ve bu h\u00fckme dayan\u0131larak haz\u0131rlanan Kad\u0131n \u00c7al\u0131\u015fanlar\u0131n Gece Postalar\u0131nda \u00c7al\u0131\u015ft\u0131r\u0131lma Ko\u015fullar\u0131 Hakk\u0131nda Y\u00f6netmelik h\u00fck\u00fcmlerinin, onsekiz ya\u015f\u0131n\u0131 doldurmu\u015f kad\u0131n i\u015f\u00e7iler bak\u0131m\u0131ndan uygulanabilece\u011fi, ayr\u0131ca 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu&#8217;nun &#8220;G\u00fcn\u00fcn 24 saatinde devaml\u0131l\u0131k g\u00f6steren hizmetlerde \u00e7al\u0131\u015fma saat ve usul\u00fcn\u00fcn tesbiti&#8221; ba\u015fl\u0131kl\u0131 101 inci maddesinin birinci f\u0131kras\u0131nda d\u00fczenlenen <b>&#8220;(De\u011fi\u015fik: 132\/2011-6111\/105 md.) G\u00fcn\u00fcn yirmid\u00f6rt saatinde devaml\u0131l\u0131k g\u00f6steren hizmetlerde \u00e7al\u0131\u015fan Devlet memurlar\u0131n\u0131n \u00e7al\u0131\u015fma saat ve \u015fekilleri kurumlar\u0131nca d\u00fczenlenir.&#8221;<\/b> h\u00fckm\u00fcn\u00fcn; Kad\u0131n \u00c7al\u0131\u015fanlar\u0131n Gece Postalar\u0131nda \u00c7al\u0131\u015ft\u0131r\u0131lma Ko\u015fullar\u0131 Hakk\u0131nda Y\u00f6netmeli\u011fin 11 inci ve Gebe veya Emziren<\/p>\n<p style=\"text-align: justify;\">Kad\u0131nlar\u0131n \u00c7al\u0131\u015ft\u0131r\u0131lma \u015eartlar\u0131yla Emzirme Odalar\u0131 ve \u00c7ocuk Bak\u0131m Yurtlar\u0131na Dair Y\u00f6netmeli\u011fin 5 inci maddelerinde yer alan, <b>&#8220;Bu Y\u00f6netmelik h\u00fck\u00fcmlerinin uygulanmas\u0131nda \u00f6ncelikle \u00e7al\u0131\u015fan\u0131n tabi oldu\u011fu ilgili mevzuat h\u00fck\u00fcmleri dikkate al\u0131naca\u011f\u0131, 6331<\/b> say\u0131l\u0131 <b>Kanun kapsam\u0131nda olup kendi \u00f6zel mevzuatlar\u0131nda h\u00fck\u00fcm bulunmamas\u0131 halinde \u00e7al\u0131\u015fanlar a\u00e7\u0131s\u0131ndan bu Y\u00f6netmelik h\u00fck\u00fcmleri uygulan\u0131r&#8221;<\/b> d\u00fczenlemesi bak\u0131m\u0131ndan, uygulamada \u00f6nceli\u011fi oldu\u011fu sonucuna var\u0131larak, g\u00fcn\u00fcn 24 saatinde hizmetin s\u00fcreklili\u011fi esas\u0131na g\u00f6re faaliyette bulunulan sa\u011fl\u0131k tesislerinde Devlet memuru stat\u00fcs\u00fcnde g\u00f6rev yapan kad\u0131n \u00e7al\u0131\u015fanlar bak\u0131m\u0131ndan bu Y\u00f6netmelik h\u00fck\u00fcmlerinin uygulanma kabiliyetinin bulunmad\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclmektedir.<\/p>\n<p style=\"text-align: justify;\">Yine, 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun &#8220;Gece s\u00fcresi ve gece \u00e7al\u0131\u015fmalar\u0131&#8221; ba\u015fl\u0131kl\u0131 69 uncu maddesinin birinci f\u0131kras\u0131nda &#8220;\u00c7al\u0131\u015fma hayat\u0131nda &#8220;gece&#8221; en ge\u00e7 saat 20.00&#8217;de ba\u015flayarak en erken saat 06.00&#8217;ya kadar ge\u00e7en ve her halde en fazla onbir saat s\u00fcren d\u00f6nemdir.<\/p>\n<p style=\"text-align: justify;\">Baz\u0131 i\u015flerin niteli\u011fine ve gere\u011fine g\u00f6re yahut yurdun baz\u0131 b\u00f6lgelerinin \u00f6zellikleri bak\u0131m\u0131ndan, \u00e7al\u0131\u015fma hayat\u0131na ili\u015fkin &#8220;gece&#8221; ba\u015flang\u0131c\u0131n\u0131n daha geriye al\u0131nmas\u0131 veya yaz ve k\u0131\u015f saatlerinin ayarlanmas\u0131, yahut g\u00fcn d\u00f6neminin ba\u015flama ve bitme saatlerinin belirtilmesi suretiyle birinci f\u0131kradaki h\u00fckm\u00fcn uygulama \u015fekillerini tespit etmek yahut baz\u0131 gece \u00e7al\u0131\u015fmalar\u0131na herhangi bir oranda fazla \u00fccret \u00f6denmesi usul\u00fcn\u00fc koymak veyahut gece i\u015fletilmelerinde ekonomik bir zorunluluk bulunmayan i\u015fyerlerinde is\u00e7ilerin gece \u00e7al\u0131\u015fmalar\u0131n\u0131 va\u015fak etmek \u00fczere y\u00f6netmelikler c\u0131kart\u0131labilir.<\/p>\n<p style=\"text-align: justify;\">\u0130s\u00e7ilerin gece \u00e7al\u0131\u015fmalar\u0131 vedibucuk saati ge\u00e7emez.&#8221; h\u00fckm\u00fc vazolunmu\u015ftur. B\u00f6ylelikle i\u015f\u00e7ilerin gece \u00e7al\u0131\u015fma usulleri d\u00fczenlenmi\u015f, s\u00f6z konusu maddenin son f\u0131kras\u0131nda yer alan t\u00fcm i\u015f\u00e7ilerin gece \u00e7al\u0131\u015fmalar\u0131n\u0131n yedibu\u00e7uk saati ge\u00e7emeyece\u011fi h\u00fckm\u00fcne paralel olarak da, Kad\u0131n \u00c7al\u0131\u015fanlar\u0131n Gece Postalar\u0131nda \u00c7al\u0131\u015ft\u0131r\u0131lma Ko\u015fullar\u0131 Hakk\u0131nda Y\u00f6netmeli\u011fin 5 inci maddesinde, &#8220;Kad\u0131n \u00e7al\u0131\u015fanlar her ne \u015fekilde olursa olsun gece postas\u0131nda yedi bu\u00e7uk saatten fazla \u00e7al\u0131\u015ft\u0131r\u0131lamaz.&#8221; H\u00fckm\u00fc getirilmi\u015ftir. Bu kapsamda konu de\u011ferlendirildi\u011finde de, ilgili Y\u00f6netmelik h\u00fck\u00fcmlerinin Devlet memuru olarak g\u00f6rev yapan kad\u0131n \u00e7al\u0131\u015fanlar\u0131 kapsamad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Yukar\u0131da ayr\u0131nt\u0131l\u0131 olarak Kurumumuza ba\u011fl\u0131 sa\u011fl\u0131k tesislerinde g\u00f6rev yapan kad\u0131n \u00e7al\u0131\u015fanlar i\u00e7in ilgili Y\u00f6netmelik h\u00fck\u00fcmlerinin nas\u0131l yorumlanmas\u0131 gerekti\u011fi izah edilmeye \u00e7al\u0131\u015f\u0131lm\u0131\u015f ise de, uygulamada Kad\u0131n \u00c7al\u0131\u015fanlar\u0131n Gece Postalar\u0131nda \u00c7al\u0131\u015ft\u0131r\u0131lma Ko\u015fullar\u0131 Hakk\u0131nda Y\u00f6netmeli\u011fin &#8220;Gebelik ve anal\u0131k durumunda \u00e7al\u0131\u015ft\u0131r\u0131lma yasa\u011f\u0131&#8221; ba\u015fl\u0131kl\u0131 9 uncu maddesinin birinci f\u0131kras\u0131nda yer alan, &#8220;Kad\u0131n \u00e7al\u0131\u015fanlar, gebe olduklar\u0131n\u0131n doktor raporuyla tespitinden itibaren do\u011fuma kadar, emziren kad\u0131n \u00e7al\u0131\u015fanlar ise do\u011fum tarihinden ba\u015flamak \u00fczere kendi mevzuatlar\u0131ndaki h\u00fck\u00fcmler sakl\u0131 kalmak kayd\u0131yla bir y\u0131l s\u00fcre ile gece postalar\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lamazlar.&#8221; h\u00fckm\u00fc ile Gebe veya Emziren Kad\u0131nlar\u0131n \u00c7al\u0131\u015ft\u0131r\u0131lma \u015eartlar\u0131yla Emzirme Odalar\u0131 ve \u00c7ocuk Bak\u0131m Yurtlar\u0131na Dair Y\u00f6netmeli\u011fin &#8220;Gece \u00e7al\u0131\u015fmas\u0131&#8221; ba\u015fl\u0131kl\u0131 8 inci maddesinde yer alan, &#8220;(1) Kad\u0131n \u00e7al\u0131\u015fanlar, gebe olduklar\u0131n\u0131n sa\u011fl\u0131k raporuyla tespitinden itibaren do\u011fuma kadar ge\u00e7en s\u00fcrede gece \u00e7al\u0131\u015fmaya zorlanamazlar.(2) Yeni do\u011fum yapm\u0131\u015f \u00e7al\u0131\u015fan\u0131n do\u011fumu izleyen bir y\u0131l boyunca gece \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 yasakt\u0131r. Bu s\u00fcrenin sonunda sa\u011fl\u0131k ve g\u00fcvenlik a\u00e7\u0131s\u0131ndan sak\u0131ncal\u0131 oldu\u011funun sa\u011fl\u0131k raporu ile belirlendi\u011fi d\u00f6nem boyunca gece \u00e7al\u0131\u015ft\u0131r\u0131lmaz.&#8221;<\/p>\n<p style=\"text-align: justify;\">h\u00fck\u00fcmlerinin kad\u0131n memurlar bak\u0131m\u0131ndan uygulan\u0131p uygulanmayaca\u011f\u0131 ya da nas\u0131l uygulanmas\u0131 gerekti\u011fi hususunda teredd\u00fcte d\u00fc\u015f\u00fcld\u00fc\u011f\u00fc g\u00f6r\u00fclmektedir. Yap\u0131lan a\u00e7\u0131klamalara ilaveten, s\u00f6z konusu d\u00fczenlemelerin, kendi mevzuat\u0131nda h\u00fck\u00fcm bulunan Devlet memuru personel bak\u0131m\u0131ndan uygulanamayaca\u011f\u0131, bu ki\u015filer i\u00e7in 657 say\u0131l\u0131 Kanun&#8217;un 101 inci maddesinin ikinci f\u0131kras\u0131nda sarih bir bi\u00e7imde d\u00fczenlenen <b>&#8220;Ancak, kad\u0131n memurlara; tabip raporunda belirtilmesi halinde hamileli\u011fin yirmi d\u00f6rd\u00fcnc\u00fc haftas\u0131ndan \u00f6nce ve her halde hamileli\u011fin yirmi d\u00f6rd\u00fcnc\u00fc haftas\u0131ndan itibaren ve do\u011fumdan sonraki iki y\u0131l s\u00fcreyle gece n\u00f6beti ve gece vardiyas\u0131 g\u00f6revi verilemez. Engelli memurlara da iste\u011fi d\u0131\u015f\u0131nda gece n\u00f6beti ve gece vardiyas\u0131 g\u00f6revi verilemez.&#8221;<\/b> h\u00fckm\u00fcn\u00fcn uygulanmas\u0131na devam olunaca\u011f\u0131nda bir teredd\u00fct bulunmamaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu&#8217;nun 104 \u00fcnc\u00fc maddesinin (D) f\u0131kras\u0131nda d\u00fczenlenen <b>&#8220;Kad\u0131n memura, \u00e7ocu\u011funu emzirmesi i\u00e7in do\u011fum sonras\u0131 anal\u0131k izni s\u00fcresinin bitim tarihinden itibaren ilk alt\u0131 ayda g\u00fcnde \u00fc\u00e7 saat, ikinci alt\u0131 ayda g\u00fcnde bir bu\u00e7uk saat s\u00fct izni verilir. S\u00fct izninin hangi saatler aras\u0131nda ve g\u00fcnde ka\u00e7 kez kullan\u0131laca\u011f\u0131 hususunda, kad\u0131n memurun tercihi esast\u0131r.&#8221;<\/b> h\u00fckm\u00fcnde ge\u00e7en &#8220;g\u00fcnde&#8221; ibaresinden g\u00fcnl\u00fck mesai olan 8 saat mi yoksa t\u00fcm 8-16 veya 24 saat \u00e7al\u0131\u015fmalar\u0131n hepsinin ayn\u0131 \u015fekilde &#8220;g\u00fcn&#8221; olarak d\u00fc\u015f\u00fcn\u00fcl\u00fcp toplamda 1,5 saat s\u00fct izni mi verilmesi gerekti\u011fi, g\u00fcnde 8 saat mesai yapan personelin kullanaca\u011f\u0131 s\u00fct izni s\u00fcresi 1,5 saat olarak hesaplanacak ise 24 saat n\u00f6bet tutan ve ertesi 2 g\u00fcn izin kullanan personelin ka\u00e7 saat s\u00fct izni kullanaca\u011f\u0131 hususuna gelince; bu durumda, 657 say\u0131l\u0131 Kanun&#8217;un 101 inci maddesi ve Yatakl\u0131 Tedavi Kurumlan \u0130\u015fletme Y\u00f6netmeli\u011finin ilgili maddelerinin birlikte de\u011ferlendirilmesi gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">Yatakl\u0131 Tedavi Kurumlan i\u015fletme Y\u00f6netmeli\u011finin &#8220;N\u00f6bet T\u00fcrleri&#8221; ba\u015fl\u0131kl\u0131 42 nci maddesinde &#8220;N\u00f6bet hizmetleri evde n\u00f6bet, normal, acil, bran\u015f n\u00f6beti olarak d\u00f6rt \u015fekilde y\u00fcr\u00fct\u00fcl\u00fcr. Acil ve bran\u015f n\u00f6betlerinin hangi hallerde, tutulaca\u011f\u0131 hastanenin t\u00fcr\u00fcne, i\u015f durumuna, personel mevcuduna, hizmetin gereklerine g\u00f6re ba\u015ftabib taraf\u0131ndan tesbit edilir. E\u011fitim Hastanelerinde de uzman ve uzmanl\u0131k e\u011fitimi g\u00f6renlerden kimlerin hangi n\u00f6bete gireceklerini ve ne n\u00f6beti tutacaklar\u0131n\u0131 da ba\u015ftabib tesbit eder.<\/p>\n<p style=\"text-align: justify;\"><b>A)<\/b> \u0130cap\u00e7\u0131 n\u00f6beti (Ev n\u00f6beti): Uzman adedi n\u00f6bet tutacak miktarlardan az, fakat birden fazla olan kurumlarda uzmanlar s\u0131rayla ev n\u00f6betini tutarlar. Bunun i\u00e7in ayl\u0131k ev n\u00f6bet listeleri haz\u0131rlan\u0131r. Ev n\u00f6bet\u00e7isi mesai saatleri d\u0131\u015f\u0131nda kurumun idari ve t\u0131bbi her t\u00fcrl\u00fc gereklerinden sorumludur. Ev n\u00f6bet\u00e7isi ak\u015fam vizitlerini yapmaya, mesai d\u0131\u015f\u0131nda bulundu\u011fu yeri bildirmeye, kuruma her davette gelmeye mecburdur.<\/p>\n<p style=\"text-align: justify;\"><b>B)<\/b> Normal N\u00f6betler: Mesai saatleri d\u0131\u015f\u0131nda personelin mesai ba\u015flang\u0131\u00e7 saatini de\u011fi\u015ftirerek veya vardiye sistemi ile g\u00f6rd\u00fcr\u00fclemeyen veyahut bunlar\u0131n d\u0131\u015f\u0131nda kalan hizmetlerin y\u00fcr\u00fct\u00fclmesi i\u00e7in d\u00fczenlenen n\u00f6bet \u015feklidir. Bundan ama\u00e7; ilgili hizmetin mesai saati d\u0131\u015f\u0131ndaki devam\u0131n\u0131 s\u00fcrd\u00fcrerek idari ve t\u0131bbi hizmetlerde s\u00fcreklilik sa\u011flamaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Acil n\u00f6betler: Uzman durumu m\u00fcsait olan kurumlarda l\u00fczum g\u00f6r\u00fclen bran\u015flar i\u00e7in normal n\u00f6bete ilave olarak ayr\u0131ca acil n\u00f6beti konulabilir. . Acil n\u00f6beti tutanlar bir ba\u015fka n\u00f6bete dahil edilmezler. Acil n\u00f6beti tutan uzman\u0131n talebi \u00fczerine yap\u0131lacak, \u00e7a\u011fr\u0131ya ilgili dal uzman\u0131 ve di\u011fer personel uymaya zorunludur.<\/p>\n<p style=\"text-align: justify;\">C) Bran\u015f n\u00f6beti: Birden fazla genel cerrahi, i\u00e7 hastal\u0131klar\u0131 klinikleri ve kad\u0131n hastal\u0131klar\u0131 ve do\u011fum klini\u011fi bulunan yatakl\u0131 tedavi kuramlar\u0131nda uzman ve klinik<\/p>\n<p style=\"text-align: justify;\">adedi g\u00f6z \u00f6n\u00fcne al\u0131narak acil hizmet i\u00e7in kliniklere b\u00fct\u00fcn personeliyle birlikte bran\u015f n\u00f6beti tutturulabilir&#8230; Bran\u015f n\u00f6betlerini \u00fcstlenen klinikler o dal\u0131n acillerinin yatarak tedavi hizmetlerini de ifa ederler ve bu klinik personeline ba\u015fkaca n\u00f6bet hizmetleri<\/p>\n<p style=\"text-align: justify;\">verilmez.&#8221;
